The following questions and answers provide additional guidance to borrowers whose mortgage loans were transferred from Taylor, Bean & Whitaker (TBW) to one of the following Freddie Mac Servicers: Cenlar FSB (866-430-9689), Saxon Mortgage Services (888-422-6451) or Ocwen Loan Servicing (800-74-OCWEN).

Home Affordable Refinance Options

  1. Why can't Cenlar, as my current mortgage servicer, refinance my mortgage under the Home Affordable Refinance program (HARP)?
  2. Can Cenlar help me find a Freddie Mac-approved lender that is participating in HARP?
  3. If Cenlar provides me with information about a Freddie Mac-approved lender that participates in HARP, do I have to use that lender to refinance my mortgage?

2009 Mortgage Interest Statements

  1. If the servicing of my loan was transferred from TBW to Cenlar, will I receive a 2009 Mortgage Interest Statement (Form 1098) from both servicers?
  2. What should I do if I find a discrepancy in my 2009 Mortgage Interest Statement?
  3. How soon after funds are released from the bankruptcy court will Cenlar credit my account for my missing payment(s) or payoff?

Home Affordable Refinance Options

  1. Why can't Cenlar, as my current mortgage servicer, refinance my mortgage under the Home Affordable Refinance program (HARP)?
    While Cenlar specializes in mortgage servicing, it does not originate new loans and, as a result, is unable to refinance your mortgage.

  2. Can Cenlar help me find a Freddie Mac-approved lender that is participating in HARP?
    Yes. Please visit Cenlar's Web site at www.Cenlar.com/TBW.htm for further information.

  3. If Cenlar provides me with information about a Freddie Mac-approved lender that participates in HARP, do I have to use that lender to refinance my mortgage?
    No. You may work with any Freddie Mac-approved lender that is participating in the program. We encourage you to contact lenders in your community to find out if they are an approved Freddie Mac lender and if they participate in HARP.

2009 Mortgage Interest Statements

  1. If the servicing of my loan was transferred from TBW to Cenlar, will I receive a 2009 Mortgage Interest Statement (Form 1098) from both servicers?
    No. You will receive a single 2009 Mortgage Interest Statement from Cenlar that reflects all funds posted to your account in 2009.

  2. What should I do if I find a discrepancy in my 2009 Mortgage Interest Statement?
    If you find a discrepancy in your 2009 Mortgage Interest Statement, you should contact Cenlar directly in writing. Your written communication should include the following information:

    • Your loan number.
    • The specific reason you believe your 2009 Mortgage Interest Statement is incorrect.
    • If you believe a payment you made is not reflected in your 2009 Mortgage Interest Statement include supporting documentation that demonstrates proof of payment using one of the following methods:
      • Paper payments – Copy of any cancelled checks, money orders or cashier's checks for payments you believe were not credited. The copies should include the front and back of the cancelled item, including the date paid and dollar amount.
      • Electronic payments – Confirmation of online or telephone payments, including a copy of your bank statement(s) indicating the date paid and the amount of payment(s).
      • Wire transfers – Wire confirmation from your bank showing Federal Reserve tracking number(s) and proof the payment(s) was wired, including a copy of your bank statement(s) indicating date of withdrawal for wire transfer(s).
    • For payoffs from the sale of your property or a refinance, you must provide evidence of payoff funds remitted (either wire transfer confirmation or a copy of the front and back of the cancelled check, as well as the HUD 1 settlement statement you received at the closing of your new loan).

    If Cenlar determines there was an error in your 2009 Mortgage Interest Statement and/or verifies your supporting documentation, it will credit your account and file a corrected Mortgage Interest Statement with the IRS, providing a copy to you within 30 days of the verification.

  3. How soon after funds are released from the bankruptcy court will Cenlar credit my account for my missing payment(s) or payoff?
    Payments will be applied to your account as soon as the funds are released from the bankruptcy court. Alternatively, you may contact Cenlar directly in writing, providing the supporting documentation outlined in Q&A 5, to have your account credited once Cenlar has verified your supporting documentation.

  4. Should I wait to file my 2009 tax return until I am sure that any discrepancies in my 2009 Mortgage Interest Statement are resolved?
    You should contact your tax advisor for tax advice.

  5. Will I receive a new 2009 Mortgage Interest Statement once Cenlar has posted a missing payment to my account?
    Yes. Once Cenlar verifies your supporting documentation, it will credit your account and file a corrected Mortgage Interest Statement with the IRS, providing a copy to you within 30 days of the verification.

  6. What if I already sent Cenlar supporting documentation for payments that were not credited to my account and my Mortgage Interest Statement is incorrect?
    If you have recently provided Cenlar documentation related to payments that were not credited to your account, no additional action is required. Once Cenlar verifies your supporting documentation, it will credit your account and file a corrected Mortgage Interest Statement with the IRS, providing a copy to you within 30 days of the verification.

  7. What if I can't produce supporting documentation for payments I made that are not reflected in my 2009 Mortgage Interest Statement?
    If you made payments that are not reflected in your 2009 Mortgage Interest Statement, but are unable to provide supporting documentation as outlined in Q&A 5, Cenlar will apply payments to all impacted accounts as soon as the funds are released from the bankruptcy court. Because of the ongoing bankruptcy proceeding, we are not able to estimate when the funds currently deposited in TBW accounts will be released.
