Terrorism Risk Insurance Program Reauthorization

Last week, President Barack Obama signed into law the Terrorism Risk Insurance Program Reauthorization Act of 2015, which extends the Terrorism Risk Insurance Act of 2002 (TRIA) through December 31, 2020. Since TRIA has been extended, Freddie Mac considers that terrorism insurance is commercially available both presently and retroactively to December 31, 2014.
Accordingly, Freddie Mac is reiterating its position that borrowers are required to obtain and maintain terrorism insurance coverage according to the Freddie Mac Multifamily Seller/Servicer Guide, as well as the provisions in the Loan Agreement or Security Instrument.
Servicers should advise borrowers to consult with their insurance agents and brokers to ensure that coverage has been maintained per the applicable Loan Agreement or Security Instrument provision.
